Albany Police Department spokesman pleads not guilty to DWI charge

ALBANY – James Miller, a detective and longtime spokesman for the Albany Police Department, pleaded not guilty Monday at his arraignment for allegedly driving while intoxicated.

Miller, who has been with the department for 19 years, was suspended without pay by Chief Steven Krokoff pending an internal investigation after the arrest, which came around 9:30 p.m. Friday. Miller was driving a department vehicle at the time, the chief said, and allegedly refused to submit to a breathalyzer.

Before he pleaded not guilty Monday with attorney Joseph Granich at his side, Miller emailed a brief statement to the media.

"I would just like to say that I am saddened and regret the negative publicity that this situation has put on my family, the entire Albany Police Department and the citizens of Albany," it read. "For over 19 years with the police department I have handled my position responsibly, with dignity and with pride. As I move forward it is my full intent to approach my current situation the same way."

Miller was pulled over at North Pearl and Orange streets for allegedly driving without his headlights on. He was charged with DWI and failing to submit to a chemical test to determine his blood-alcohol level. Failing to submit to such testing typically results in the suspension of one’s license following a DMV hearing, regardless of the outcome of the DWI case.

On Monday, police named Deputy Chief Stephen Reilly the department’s public information officer for the time being.

" let this be a lesson to anyone that is pulled over while intoxicated. refuse the tests and plead not guilty. if the top cop is using this method you can be damn sure that its the best way to beat the charges. what a poor example this man has set. "

" His licese will be suspended for a period of 6 months even if he is found not guilty for refusing the Breathalyzer test. Without the proof from the test he will likely be found not guilty, but will still suffer the loss of driving privileges. "

" believe me, he can get off with no penalty at all. he can contest the reason for why he was pulled over and get all of the charges tossed. ive seen it happen before. if a cop is doing this, it is obviously the best way to beat the charges. just giving everyone a heads up. "
